The Maharashtra Labour Welfare Fund Act 1953

The Act has been constituted for financing of activities to promote welfare in the respective States.
 
Applicability
The Act is applicable to an establishment, which engages 5 or more persons in the establishment.
 
ELIGIBILITY
Any person employed directly or indirectly (through Contractor) for wages and does not include persons employed in Managerial category and employed in Supervisory category who draws wages exceeding Rs. 3,500/-p.m.

The contribution payable is on half yearly basis for the period ending 30th June & 31st December. Contribution to be recovered from the employees salary in respect of employee who are present as on 30th June & 31st December respectively.
 
Payment:
The contribution recovered from the salary of June & December alongwith employer’s contribution as mentioned above to be deposited with the ‘Welfare Fund Commissioner’ in Form A-1 (Challan-Cum-Return in Form A- 1) on or before 15th July or 15th January respectively. The Cheque to be drawn in favour of the “Welfare Commissioner, Maharashtra Labour Welfare Board” and to be deposited at the following address.

Unpaid Accumulation:
An unclaimed accumulation in respect of employees outstanding for a period of 3 years, shall be deposited with the Welfare Commissioner. Unpaid accumulation shall be deposited in Form A-1 alongwith the list of employees in respect of whom the accumulations are outstanding.

The Labour Welfare Fund Act is a State enactment and the contribution in respect of the employees engaged in respective States to be deposited with the State Welfare Commissioner.

There is no separate procedure for registration under the Act. Whenever the establishment is set up in any State the first contribution to be deposited in Form A-1 (for the State of Maharashtra) or in the prescribed Form for the other States.   
                
On depositing the first contribution establishment code is allotted by the office of Welfare Fund Commissioner.

 
Application of Fund :
The Fund is applied for welfare of workers/Labour in following manner
  1. Community and social education centres including reading rooms and libraries;
  2. Community necessities;
  3. Games and sports;
  4. Excursions, tours and holiday homes;
  5. Entertainment and other forms of recreations;
  6. Home industries and subsidiary occupations for women and unemployed persons
  7. Corporate activities of a social nature and
  8. Such other objects as would in the opinion of the State Government improve the standard of living and improve or upgrade the social conditions of labour.
